Gold in the Sunshine on Your Roof – Solar Facility Rooftop Leases

Concern over greenhouse gas emissions (GHGs) has produced a new phenomenon – leases of rooftop space for the installation and fda acomplia operation of solar power facilities.
Last May Ontario passed the Green Energy Act. One of its main objectives was to establish a feed-in tariff program (a “FIT” Program) whereby the Ontario Power Authority (the “OPA”) committed to purchase, at very favourable rates, all of the green energy produced cheap clomid in the Province. In response to this incentive, owners of buildings are likely to be approached by solar power companies wishing to lease rooftop space to install and operate green energy systems.

Pros and Cons

Once an application is approved by the OPA, the applicant must sign a power purchase contract with the OPA for a term of 20 years. An important component of that contract is the transfer to the OPA of all of the environmental attributes associated with the project. As a consequence, any carbon credits and renewable energy credits belong to the OPA and not to the solar power company or the landlord of the property on which the solar power facility is installed.

Carbon credits arise under “cap and trade” systems such as that which Ontario intends to impose. Under a cap and trade system, energy generating plants, commercial buildings, factories and other facilities are restricted to a prescribed annual allotment of permitted tonnes of GHGs emitted by their operations. If the annual allotment is exceeded, the facility owner must pay a fee or fine to the regulating authority unless it is able to purchase carbon credits. Carbon credits arise where a facility succeeds in keeping or reducing the GHGs that it emits below its allotment. Carbon credits can be bought and sold on a commodities market.

Renewable energy credits occur where an authority imposes a requirement that a stated percentage of energy used must be provided by renewable energy sources such as solar power, wind power, biomass and similar renewable energy facilities. To meet annual targets, users of energy can purchase renewable energy directly from a supplier or they can purchase credits that are used to fund renewable energy products. Twenty-nine U.S. states and the District of Columbia have established regulatory schemes mandating that the energy production of the state must be from renewable energy. U.S. federal legislation is expected to establish a national program and Canada will almost certainly follow suit.

At this time, environmental attributes do not have a large value, but it is anticipated that their value will increase (perhaps very dramatically) within the not too distant future. Accordingly, before leasing out a roof to a solar power company, consideration should be given to the potential value of those environmental attributes. In the absence of favourable tax treatment, government grants or other forms of incentive, the cost of installing a solar power facility on a roof might make the investment unfeasible. Typically, a building, even one with a large roof, would provide no more than 20% of its energy consumption through rooftop solar panels. Furthermore, at present, the cost of electricity purchased from the grid is still relatively low. However, as the volume of solar power facilities production increases and anticipated developments in technology take hold, it is expected that the cost of installing solar panels will reduce substantially. It may be in the interest of a building owner to hold off signing away the ability to install its own solar panels and to use its own electricity so that it can benefit directly from the carbon credits and renewable energy credits that the project gives rise to.

On the other hand, the time frame during which environmental attributes are likely to become valuable, and the extent to which they become valuable, is uncertain. It may take several years before the markets mature and trading produces substantial benefits.

Also, at the end of the term of the rooftop lease (typically a 20 year period), a building owner may find that the ownership of an intact and functioning solar power facility represents a substantial benefit, particularly when the building owner has not itself been required to contribute to the cost of the installation or maintenance. Solar power facilities will normally have a useful life well in excess of 20 years. The building owner will be able to deal with the environmental attributes in whatever way it wishes at the end of the lease and at the same time will enjoy the benefit of an essentially free form of renewable energy on its roof. Alternatively, the building owner may choose to itself enter into a power purchase agreement with the OPA at the end of the term of the rooftop lease, assuming the FIT Program still exists.

A further benefit flows from the fact that the solar panels will normally reduce energy costs in the building due to the shading effect of the panels. Also, depending on the type of installation, the panels may extend the useful life of a roof by serving as a buffer from the elements.

Some Special Concerns

Assuming a building owner has elected to lease its roof to a solar power company, several concerns must be addressed:

• Non-disturbance agreements, consents or acknowledgements may be needed from mortgagees of the building or from ground landlords.

• The solar equipment may be subject to a personal property security interest or lien in favour of a lender. The rooftop tenant’s lender will seek agreements from the landlord and the owner of the building as well as the mortgagees of the building to the effect that the solar power facility will not be treated as a fixture and will remain the property of the rooftop tenant. The lender will also seek an opportunity to cure defaults of the rooftop tenant to avoid cancellation of the lease. A forbearance commitment and an opportunity to assign or transfer the rooftop lease to the purchaser of the solar power facility may also be required.

• The production, review and approval of detailed engineering drawings, inspection rights, supervision rights and adherence to approved plans as well as all governmental requirements will be important elements of the rooftop lease, particularly with regard to the integrity of the roof and structure of the building.

• Alteration rights will also be contentious. The tenant will need to limit changes to the landlord’s property that would interfere with sunlight, while the landlord will be concerned about alterations that might affect its building.

• Particular attention to maintenance and repair obligations must be taken to ensure that the solar power facility is always maintained properly and safely. Solar power facilities will normally have a life expectancy well beyond the term of the lease and the landlord will be concerned about asset preservation.

•  A sizeable deposit will be needed to protect against damage to the building, and possibly the cost of removing the solar panels and restoring the building at the end of the term.

• There are specific insurance requirements, such as environmental damage and environmental impairment coverages, as well as boiler and machinery insurance. Risk transfer clauses, such as releases and indemnities, must also be specifically tailored.

•  The need to relocate the solar power facility, or components of it, in order to allow the landlord to maintain and repair the roof or to make alterations to the building must be negotiated.

• Snow removal and snow disposal will be a concern.

• Damage and destruction and rebuilding obligations associated with the building and the facility, and various other concerns need to be addressed.

How Geothermal Heat Pumps Work

  1. Ground source heat pumps provide heating, air conditioning, and, if so equipped, supply the house with hot water. They are smaller than a traditional heating/cooling unit and can easily be retrofitted into any home.  The mechanical components are safely located underground or within the home – which eliminates fears of vandalism or theft.  With extreme durability the parts can last a generation and require very little maintenance.  These systems do not have fans, so instead of hearing and feeling blasts of air, you will enjoy a quiet, consistent temperature throughout the day.  Geothermal heat pumps can even improve your health and reduce allergies because they excel at humidity control, thus there is a reduced chance for mold and mildew growth.

Above the ground we can expect to experience dramatic temperature changes throughout the year. However, just a few feet below the Earth’s surface the temperature remains more constant at around 50 to 60°F. A geothermal heat pump takes advantage of these more mild temperatures through a series of pipes and a heat exchanger. 

In summer, the process is reversed. The underground loop draws excess heat from the house and allows it to be absorbed by the Earth. The system cools your home in the same way that a refrigerator keeps your food cool – by drawing heat from the interior, not by blowing in cold air.

As with any heat pump, geothermal and water-source heat pumps are able to heat, cool, and, if so equipped, supply the house with hot water. Some models of geothermal systems are available with two-speed compressors and variable fans for more comfort and energy savings. They are smaller than a traditional heating/cooling unit and can easily be retrofitted into any home.

Energy Performance Certificates – How to Take Advantage of the Benefits

ENERGY PERFORMANCE CERTIFICATES

The EU Performance of Buildings Directive has resulted in the introduction of Energy Performance Certificates (EPCs) in England and Wales. From 1 October 2008 all properties – homes, commercial and public buildings – when bought, sold, built or rented have been required to provide an EPC.

The certificate gives each building a SAP rating, which equates to an energy rating from A to G, similar to the ratings given on fridges and washing machines

Certificates carry two current ratings. The environmental impact rating measures your home’s impact on the environment in terms of carbon dioxide (CO2) emissions and the energy efficiency rating which measure your home’s overall efficiency.

Each rating is based on the performance of the building itself and its services (such as heating and lighting), rather than the domestic appliances within it.

The ratings will vary according to the age, location, size and condition of the building. The potential rating on the certificate will take these factors into account, and the suggested measures will be tailored so that they are realistic for the particular building.

The certificate will make suggestions of cost effective measures to improve the energy performance of a property, which will result in lower fuel bills and less CO2 emissions which contribute to climate change. EPCs will allow prospective buyers and tenants to compare buildings on energy performance.

WHO NEEDS TO GET AN ENERGY PERFORMANCE CERTIFICATE

Homeowners – all sellers of homes need to ensure that they provide a Home Information Pack which includes an EPC for potential buyers

Homebuilders – an EPC needs to be provided to buyers of newly built properties

Landlords – need to provide an EPC to prospective tenants the first time you let or re-let your property

Commercial Buildings – owners of all commercial buildings will also have to provide an EPC when they buy, sell or let commercial premises

Fuel Poverty Grants – Warm Front

Eligibility for Warm Front grants is dependent upon the tenant being in receipt of certain benefits. This allowance can be claimed by all private landlords that pay income tax, usually individual and smaller landlords.  The LESA means that landlords can claim a deduction for income tax purposes (up to a maximum of £1,500) against their rental profit when they install cavity wall, solid wall or loft insulation, draught proofing or insulation for hot water systems in any property they let.  This is in addition to the deduction that the Inland Revenue allows for wear and tear of furniture, fixtures and fittings (currently 10%).

Enhanced Capital Allowance(ECA)

This allowance can be claimed by landlords that pay corporation tax, larger landlords and businesses.  In practice this provides the landlord with the opportunity to claim 100% of the tax back on any energy saving technology that they buy e.g. if a boiler were bought at £100 and assuming a tax rate of 30% then £30 could be claimed back in the first year.

The ECA scheme was set up to encourage UK businesses to reduce carbon emissions which contribute to climate change.  The ECA provides upfront tax relief, allowing businesses to claim 100% first year capital allowances against their taxable profits.  This can deliver a cash flow boost and shorten the payback period on investments.

HOW TO GET AN ENERGY PERFORMANCE CERTIFICATE

For residential properties you will need to find a qualified Domestic Energy Assessor (DEA), and for commercial properties you will need a Commercial Energy Assessor. You can do this by searching your local directory or internet for business listings.

Green power is heating up more and more. Especially solar power, quite literally in the case of solar thermal power. Nowadays, it’s not a question of if solar thermal can work for you. It’s more like, “What can solar thermal do for you?” And that is no small amount. Between PV and solar thermal, you can harness enough solar energy to fulfill all your home energy needs.

What is solar thermal?

As opposed to photovoltaics cheap clomid (PV), which converts sunlight directly into electricity, solar thermal collects the sun’s heat and uses it to address several needs around the home. Put simply, solar collectors heat water in a storage tank, which in turn flows to the house, providing hot water for the shower, bath, and sinks. Hot water systems are the most cost-effective type of solar system. A solar hot water system can save a family of four $300 per year, providing up to 80% of their water-heating needs.
  • Solar Space Heating is more expensive than water heating, but nonetheless is a very real possibility for solar thermal systems. They are most cost-effective in cold, sunny climates where they can be used year-round and can provide 40-80% of your heating needs. Solar space heating can also be active or passive and can be air- or liquid-based. In solar thermal heating, air or some liquid (commonly water or anti-freeze) is heated and then transferred to the living space via a heat-transfer medium and pumps in an active system. Passive solar thermal heating is possible through a variety of building-integrated technologies.
  • Solar Space Cooling is on the cutting edge of solar thermal technology. It is still quite rare for residential applications but is also quite possible. It works by using solar heat and either a desiccant or absorbent to extract the humidity (or the warm part) from air and direct the resulting dry, cool air into the home – proving, after all, that solar thermal power is cool!
  • Solar Pool Heating is another great opportunity for you to use solar thermal power. The Likely Development Of Hydrogen Supplies For The UK

There are several ways of making hydrogen in the UK. The cheapest way is to convert natural gas into hydrogen by a process called reformation. Reforming natural gas into hydrogen produces CO2 but no more than burning it. However, using the hydrogen in a hydrogen fuelcell or using the natural gas itself in a natural gas fuelcell produces at least twice as much useful energy for a given amount of natural gas than burning it (in a natural gas fuelcell the natural gas is ‘reformed’ inside the fuelcell).

Therefore to get the best use from natural gas we should endeavour to use it in fuelcells, either directly or after reforming it into hydrogen. Natural gas fuelcells will be a good bridge technology to a hydrogen-powered world.

Natural gas, i.e. methane, is a powerful greenhouse gas, 10 times more effective than CO2, so we should use up all the natural gas on Earth by burning it or using it in fuelcells before it escapes and adds to global warming. Commercial pressures are achieving this anyway and in due course natural gas will become scarce so we need to develop alternative ways to make hydrogen.

We should not rely on converting coal into hydrogen because obviously coal is not a greenhouse gas so to create CO2 as a by-product of converting coal into hydrogen is not justifiable on greenhouse gas priorities. However to convert coal into a gas suitable for use in fuelcells is better from a minimising the production of atmospheric CO2 point of view than simply burning coal as we used to. This technology may be a good way ahead for India and China to use some of their vast coal deposits.

But the UK and Europe cannot go back to increasing our reliance on coal because most of the CO2 emissions savings to date have been achieved by switching from coal to natural gas! If we did go back to coal we would be back to where we started in 1990. Nuclear power is not acceptable. So we do need to get on with developing alternative ways of making hydrogen. In the UK and Europe we are becoming dependent on natural gas which because of increasing use is going to become progressively more expensive and will eventually run out.

There are four main alternative methods available at present for producing hydrogen without producing CO2 or adding more CO2 to the atmosphere:

1) The electrolysis of water using electricity from renewable resources such as wind power, hydro-power and solar photo-voltaic cells. This method produces no carbon dioxide.

2) The chemical or clomid online thermal reformation of biomass feedstocks such as SRC (short rotation coppice) wood chips or methanol manufactured from biomass. This method releases carbon dioxide but it is all recycled by the growth of more biomass.

3) The biological reformation of biomass using micro-organisms. This method releases carbon dioxide but it is all recycled by the growth of more biomass.

4) The direct splitting of water using light with special catalysts or extreme heat, this method produces no carbon dioxide.

Of these four processes only the production of hydrogen by the electrolysis of water using electricity generated by offshore wind power is viable on a large multigigawatt scale in the UK.

Offshore wind power is the only large (ie multigigawatts) UK resource of clean renewable electricity that is likely to be available in the near future. Sufficient onshore wind power capacity is unlikely to get planning permission and the other renewables do not have sufficient capacity. The hydrogen will be manufactured in factories at the coast.

The hydrogen produced will be used for road transport applications, initially urban buses and, later on, cars.

In due course if solar-photo-voltaic (PV) electricity generation in North Africa becomes established, hydrogen, manufactured by the electrolysis of water, using the solar-PV electricity in North Africa, could be transmitted by gas pipelines across the Mediterranean Sea and throughout Europe and north into the UK. The hydrogen could then be used as a transport fuel or it could be converted into electricity and heat in fuelcell based cogeneration systems. Production could start in S. E. Spain and then expand into North Africa.

Assuming these developments take place then as a first step, the hydrogen from North Africa could be injected into the existing natural gas pipelines supplying the existing UK natural gas grid to enhance the energy value of the natural gas. This already occurs in the USA. Before we changed over to North Sea natural gas, we used town gas made from coal which was over 50% hydrogen.

The enriched natural gas will continue to be burned in existing central heating systems and cookers but new domestic systems will be based on fuelcells for the cogeneration of electricity and heat.

If hydrogen injection into existing natural gas pipelines is adopted, then only a small proportion of hydrogen can be injected because all of the gas appliances running on natural gas are sensitive to the proportions of different gasses in the gas mixture supplied. However, the volume of hydrogen to be delivered using this technique will be quite small relative to the volume of natural gas being delivered and so the gas mixture would be acceptable. It would not be possible however to keep increasing the proportion of hydrogen injected as hydrogen production increases.

What gas injection offers is an early route to market for the initial small scale production of hydrogen before separate no rx acomplia hydrogen pipelines are built. When hydrogen becomes the main energy carrier, then sections of the natural gas grid will be changed to 100% hydrogen and the existing gas appliances in the area served will have to be adjusted to burn hydrogen. This is what happened when we changed from town gas – which was over 50% hydrogen – to North Sea gas.

Hydrogen injection is a way of integrating hydrogen into the existing natural gas system. It enables existing appliances to be used to burn the hydrogen and so provide a market for early production. The enriched natural gas can also be used to run natural gas fuelcells or can be reformed at the point of use to give hydrogen for use in hydrogen fuelcells. This enables fuelcells to be introduced alongside existing appliances all using the same fuel supply system.

Eventually the whole country will go over to 100% hydrogen, the gas grid will be increased in capacity and it is possible that the national electricity grid will no longer be required as the generation of electricity becomes locally based, using hydrogen fuelcell cogeneration systems.

The hydrogen-powered cogeneration systems will range in size from less than 1 kW up to 100s of MW. These systems will be located in single homes, large buildings or serve whole communities from a cogeneration centre.

Another likely route of hydrogen supply to the UK will be as liquid hydrogen delivered by ocean tanker from Canada, where hydroelectricity will be used to electrolyse water, or from Iceland where electricity from geothermal power may be used to electrolyse water.

In the early 1990s the EEC developed at the Joint Research Centre at Ispra in Italy the concept of the Euro-Quebec Hydro-Hydrogen Project for transporting liquid hydrogen across the Atlantic in special ship mounted barges. And in Iceland there is now an Icelandic government project to change the whole country over to a hydrogen-based energy system.

In due course there will be a world-wide trade in liquid hydrogen that will underpin each individual country’s pipeline based systems. Liquid hydrogen supplies will provide security of supply and boost availability in winter by moving surplus summer production of hydrogen around the world. If there is an accident with a hydrogen tanker the hydrogen will boil away with no pollution. The process of liquefaction dissipates about 30% of the energy in the hydrogen, so pipeline distribution of hydrogen as a gas will always be the preferred option for bulk distribution.

Many people mistakenly believe that they don’t need an inspection on a new house. The misconception is understandable because as consumers we have been conditioned to believe that consumer products of all types will be delivered without defects. Unfortunately this is not true, especially in the new construction market.

 

Quality control programs in new construction vary widely in the field and many contractors do it by the seat of their pants if at all. Most builders require that their superintendents have only a Bachelors degree in any field, Accounting will do.  They usually get away with this because they have learned from experience what kind of mistakes are going to show up as a problem during the warranty period. As a result there are likely to be hidden defects that will show up later in the life of the house, after the builder warranty has expired.

 

Homeowners often encounter buy clomid these problems after the first year or two not knowing they are related to construction error. For instance, brick veneer is installed on about 90% of the new houses built in this area. Most people do not realize that brick is not waterproof. To compensate for this, construction standards, including the building codes, require a drainage plane behind the brick along with flashing and weep holes that will guide any water that penetrates the brick, back to the outside.

 

Unfortunately I rarely see brick veneer installed with all of the required flashing. As a result water may enter the interior wall and ceiling space and cause all kinds of problems including damage to walls, ceilings and floors and issues with mold, mildew and fungus.

 

Again, most homeowners don’t realize that the problems they see even 5 or 6 years after they move in are the result of code violations. It has also been my experience that a large percentage of the problems I find during the inspection of a 5 to 10 year old house are the result of builder errors.

 

What Are The Most Common Construction Defects?

Unfortunately the protection afford by the official inspection departments is limited. City inspectors are stretched very thin, they may perform 15-20 inspections order cheap acomplia a day and can only spend a few minutes at a construction site during a few visits at specific phases of construction.

 

Code enforcement is about as effective as speed enforcement is on our highways. New Home Inspection Requirements Have Begun.

 

On September 1, 2008, new homes and major remodeling home improvement projects will require a third-party home inspection.  The new home inspection requirements will require a minimum of three inspections for all homes built or remodeled in unincorporated areas or in cities that do not offer municipal inspections.  The Texas Residential Construction Commission has enacted the mandatory reviews.  All projects started after September 1, 2008 will be subject to the new requirements. 

 

Three Inspections Required:

 

1.  The foundation inspection must be conducted prior to the placement of concrete.

2.  The framing and mechanical systems inspection must be conducted prior to the placement of exterior wall insulation or interior wall coverings.

3.  The final inspection is performed when the home is complete.

 

The inspections will have to be completed by a third-party independent professional Texas Real Estate Commission inspector.    

 

There will be fines levied against builders and re-modelers that fail to have their projects inspected.

 

The Texas Residential Construction Commission has put together a list of Most Frequently Asked Questions about the program.  They have also added Contracted Inspections Instructions. 

 

What does the Foundation inspection look for?

 

Compliance with engineered drawings Proper placement, support, sizing, and spacing of graded rebar Ensuring proper beam depth, width, and placement Vapor/moisture barrier placement check If drawings are not sealed by an engineer, then the foundation must comply with the building code.

 

What does the Framing, Mechanical inspection look for?

 

Electrical systems must be properly grounded

All connections in junction boxes

Proper gauge wiring is installed

Outlets spaced properly

Adequate access to machinery

Duct work should not be encumbered by other building materials

Ducts are installed to applicable building code

Roof is supported and sloped

Plumbing system should be reviewed

 

What does the final inspection certify?

 

Yard is graded properly for water flow

HVAC is in complete working order

HVAC exterior unit is located on a level surface

All air ducts free of obstruction

Doors and windows operate properly

Finish materials are properly installed

The flat work around home is free of any structural cracks

All roof cladding is installed to manufacturer’s recommendations

Flashing is installed

Fixtures are correctly installed and working

All appliances are installed and working

There are no apparent safety issues.

 

This is not a complete list of everything the inspections cover.  The inspector must also verify the project meets the applicable building code.  You might hear some rumbling and grumbling from the contractors you know but the program is designed for the good of the consumer – you and me.  Three phase inspections are really very minimal to require for a residential structure.  The home builder I worked for required ten inspections before they would deliver a completed home to a new home owner.

Starting as of January, the good news is that builders are required to perform to the code requirements and knowing this can help you get the problems corrected. However, this will only happen if you have an inspector who knows construction and the codes.

 

When Hiring an Inspector For New Construction, What should I Look For?

 

First you need an inspector who has extensive experience in new construction along with the education necessary to under stand the building science behind the codes.

 

You also need an inspector who knows the codes and who is not afraid to use them. Believe it or many home inspectors are afraid to use the codes when documenting problems with new construction. Many are so afraid of the “C” word that they will ignore obvious problems related to code provisions because they are afraid you will hold them to a higher standard. They have been told this by so called experts. When interviewing an inspector ask them if they will report on code violations they may see and give references to the codes. If they say no, keep moving.

 

  1. Bottom line, if a home inspector will not provide references to the building codes, manufactures installation instruction or other industry standards he is simply wasting your time and money.

 

What Will a New Construction Inspection Cost?

 

If you don’t care what kind of inspection you get, you can find inspectors who will do just about any job for $200. Dig a little deeper and you can probably find an inspector for less than $200.

 

The inspection industry is covered up with unqualified inspectors who receive bogus “certification” from phony inspector mills and virtual associations. One association will let you take a free online exam, pay a fee and become a “Certified Master Inspector.” There are documented cases of Jr. High School kids passing the test!

 

If you need to save a few bucks on the inspection of one of your biggest investments, just remember, Buyer Beware.  If you want a real inspection performed by a knowledgeable professional inspector, you are going to spend between $250 to $400 for most inspections. If your new house is really big, you’ll pay even more.

 

Special Scheduling Consideration for New Consideration

 

Unless the new house you are purchasing already has a Certificate of Occupancy, scheduling an inspection on a house under construction can be difficult. All too often the builder will commit to a completion date which they will fail to meet. As a matter of fact they will commit to and fail to meet one deadline after another and before you know it you are pushed up to the closing date.

 

If you have an inspection scheduled and the builder gives you less 48 hours notice that they will not have the house ready, it is best to proceed with the inspection at the scheduled time and arranged for return visit by the inspector once the final power is turned on. You should ask the builder to reimburse you for the cost of the return visit.

 

I have performed inspections behind these so called builders’ inspectors and new county required third-party inspectors and I have found numerous errors and omissions.  If you look closely, you will see that most Texas Home Builders have entered into agreements with large, out of town real estate inspection firms to perform all of their required inspections.  Sounds kind of fishy, like kick-backs and having the inspector on the builder’s payroll.  Whose interest do you think that inspector is looking out for, a home buyer he will never meet or the builder who is putting money in his back pocket?

On January 1 of 2010, Massachusetts residents with installed solar power will be able to take advantage of the state’s new net metering law, which provides for grid-connected renewable energy installations like wind and solar to capture retail rates for energy not used in the home.

This overturns the provisions of the 2008 Green Communities Act, which provided for wholesale rates for excess electricity generation, though the intent of the Act – which focuses on energy remains the same; to reduce the consumption of electricity. Peripheral efforts, which require utilities to ramp up their energy conservation efforts (through more efficient lighting, air conditioning, appliances, insulation and sealing building envelopes), are also underway.

Massachusetts’ demand for electricity rises at about 1 percent annually. If allowed to continue unabated, this would mandate the state to build new power plants. Under the amended Green Communities Act, state energy regulators expect demand to fall by about 1.4 percent per year, which is enough for the state to meet its rising energy needs through efficiency and conservation measures rather than the added generation anticipated by 2020 at the latest.

A similar set of natural gas efficiency programs are expected to save $1.2 billion in energy costs over the next three years, with Gov. Deval Patrick estimating the total electric and gas savings at $6.5 billion over the same period, while creating new jobs.

Though the program doesn’t officially begin until Jan. 1, property owners can begin to submit applications Dec. 1 to earn the credits they will receive if generation exceeds usage. Participating utilities include Fitchburg Gas and Electric Light Company, or FG&E (a subsidiary of Unitil Corp. a utility holding company), National Grid, NSTAR and Western Mass. Electric Company, or WMECO.

Municipal utilities are not obligated to participate, and the state has no electric cooperatives, but the law does provide for “neighborhood net metering”, or a group of 10 customers of a single utility in the same vicinity. This provision covers all classes, and may incorporate additional “customers” (including commercial enterprises) as long as the base requirements are met.

The net metering payment is in the form of credits, and these can be carried forward from month to month indefinitely. They can also be transferred to another customer within the same utility service area and the same Northeast Independent System Operator (ISO) distribution zone.

The NREL recently published a report (State of the States 2009: Renewable Energy Development and the Role of Policy) which shows that Massachusetts – ranked 31st in the U.S. in renewable energy generation – has a long way to go to meet the 1-percent load limit imposed by the new Green Communities Act provisions on renewable energy fed into the grid.

The National Renewable Energy Laboratory, or NREL – the premier organization devoted to renewable energy research and evaluation – also noted that states with renewable portfolio standards and/or net-metering rules in place generated more “clean” renewable energy than those which did not.

When you’re selling energy back to the company, your power meter runs backward. The “net metered” system therefore is highly recommended. The grid also works as your “battery backup” when your hybrid solar wind energy system doesn’t provide for your power demands.

Net-metered systems are also recommended because they are easier to install, cost less, and offer better performance.
